Sponsored Content Requirements

All Publishers on the Service must comply with these Sponsored Content Requirements (“Requirements”) when posting sponsored content. Failure to comply with these Requirements may result in your Account earnings being forfeit, your Account being suspended, or your Account being permanently terminated.

These Requirements apply equally to any website or social media you control, regardless of the platform or devices the audience use to access them. These Requirements also apply even if you don’t specifically write about a Post Intelligence product, service or program, or those of a third party as directed by Post Intelligence.

The Federal Trade Commission (“FTC”) has issued “Guides Concerning the Use of Endorsements and Testimonials in Advertising” (“FTC Guidelines”) that are intended to increase transparency in payments and gifts made to bloggers, influencers, or other endorsers (“Influencers”) that help promote a product or service. Under FTC Guidelines, Influencers and advertisers such as Post Intelligence are subject to liability for false or unsubstantiated statements, or for failing to disclose material connections between themselves and their endorsers.

You have a “material connection” to Post Intelligence if (a) Post Intelligence pays you for a specific post, or an endorsement generally, (b) Post Intelligence provides you with a free or discounted product or service, or (c) You are related to, or are friends with a Post Intelligence employee or representative.

Any user who has a material connection to Post Intelligence and creates an article, blog, social media page, post, endorsement, testimonial, communication, or other content (“Content”) that (i) discusses an advertiser or its products and services or those of a third party, or (ii) is created at the request of Post Intelligence (or its agents), must clearly and conspicuously disclose the material connection to Post Intelligence as close to the Content as possible when the material connection is not otherwise clear to an audience or is not reasonably presumed or implied.

  • Comply with the law. You are responsible for complying with the FTC’s guidelines as well as all applicable laws governing your posts.

    Please Note: if you are hosting a giveaway, contest, sweepstakes or other drawing, certain additional laws may apply that may require you to provide participants with Official Rules and specific disclosures in your promotional advertising. Entrants in said drawing must may also be required to make disclosures about their participation.

  • You must clearly and conspicuously disclose any material connection to Post Intelligence. This requirement applies to all posts, websites, and materials commented on, contributed to, created, distributed, or modified by you.

    Your disclosures must:

    • Be located at the beginning, on top of, or next to your communication, and in such a manner that re-sharing/re-posting will not remove the disclosure;
    • Be understandable for your intended audience such that the audience readily understands that your posting is not independent but rather directed by a party to whom you have a material connection;
    • Be clearly visible or audible to anyone viewing the post, message, video, page, or site, meaning:
      • Prominently presented and easy to understand in a clear format, regardless of medium.
      • Your audience must not have to scroll or search to find the disclosure.
      • For tweets and other short-form content, you must prominently place a disclosure such as #ad, #paid, or #sponsored within your post.
      • Disclosures must be repeated or persistent throughout communication (e.g. in comment-threads under sponsored posts, or multiple times in videos).
      • Disclosures should be legible without visiting a hyperlink.
    • Reveal the product or service’s typical level of quality; and
    • Include the name of the specific brand, service, or product being promoted, or those of a third party as directed by Post Intelligence, or any other entity with an interest in your communication.

    If you can’t include a disclosure in your communication for whatever reason (e.g. technical limitations, word count, etc.), you must not make the communication.

  • You must only give your honest opinion, findings, beliefs, and experiences relating to the sponsored item. All factual claims made regarding the sponsored items must be supported.

    • Do not make unsupported or dishonest claims.
    • Do not lie or deceive your audience about your sponsor, their products and services, or their competitors products and services.
    • Do not falsely represent yourself as a parent or an expert on any subject.
    • Do not claim to have used products or services you have not used.
    • You must have proof for any factual statements made about, or in relation to the product or service.
    • You must ensure all demonstrations are accurate.
    • You must remove your posting or make disclosures if a claim ceases to be truthful.
    • You must consider what a reasonable consumer would understand about your communication, including who you are or appear to be, what you say and how you say it, what you don’t say and why you don’t say it, and that a reasonable consumer may not be particularly intelligent or well-informed.
  • Use good judgment and common sense about what you post, and how.

    • Follow all relevant policies and terms of use where you make postings.
    • Use only original material created by you or properly licensed by its original creator.
    • If applicable, state that your opinion is personal and not representative of your sponsors’ views.
    • Do not disclose private information without consent or invade anyone’s privacy.
    • Do not reference or depict any celebrity, minor, or anyone who has not expressly consented to being depicted.
    • Do not disparage, libel, slander, or defame any individual, entity, product, or service, especially not competitive products or services.
    • Do not promote illegal or unsafe activities.
    • Do not promote illegal drugs, tobacco, alcohol, or guns.
    • Do not express hatred, bigotry, or racism, or make any hateful or offensive comments.
    • Do not incite violence.
    • Do not link to any Content that violates these Requirements or the law.
  • All posts are subject to review by Post Intelligence. Post Intelligence reserves the right to review and approve any posts made by the service before they are publicly posted, or after posts have been made and request immediate remove or edits at Post Intelligence’ sole discretion.

    • Certain campaigns may require approval before posts go live. You must not make any posts or uploads for said campaigns before Post Intelligence’ review is completed.
    • You must not post or share any content that has been rejected or contains confidential information.
    • You must immediately delete or withdraw sponsored posts if requested by Post Intelligence.

Post Intelligence will monitor all posts made using the platform, and the accounts of users who participate in campaigns on the platform.
